ACLU Sues DHS Over Unlawful TSA Searches And Detention

Thursday, June 18th, 2009

Treasurer Of Ron Paul’s Campaign For Liberty Detained And Interrogated For Carrying Cash At St. Louis Airport

FOR IMMEDIATE RELEASE
CONTACT: (212) 549-2666; media@aclu.org

NEW YORK – The Transportation Security Administration (TSA) is subjecting innocent Americans to unreasonable searches and detentions that violate the Constitution, according to a lawsuit filed today by the American Civil Liberties Union. The ACLU filed the complaint on behalf of a traveler who was illegally detained and harassed by TSA agents at the airport for carrying approximately $4,700 in cash.

“Airport searches are the most common encounters between Americans and law enforcement agents. That’s why it is so important for TSA agents to do the job they were trained to do and not engage in fishing expeditions that do nothing to promote flight safety,” said Ben Wizner, a staff attorney with the ACLU National Security Project. “It is, of course, very important to ensure the safety of flights and keep illegal weapons and explosives off planes. But allowing TSA screeners to conduct general purpose law enforcement searches violates the Constitution while diverting limited resources from TSA’s core mission of protecting safety. For the sake of public safety and constitutional values, these unlawful searches should stop.”

On March 29, 2009, Steven Bierfeldt was detained in a small room at Lambert-St. Louis International Airport and interrogated by TSA officials for nearly half an hour after he passed a metal box containing cash through a security checkpoint X-ray machine. Bierfeldt was carrying the cash in connection with his duties as the Director of Development for the Campaign for Liberty, a political organization that grew out of Congressman Ron Paul’s presidential campaign.

Bierfeldt was detained and questioned as he returned home from a Campaign for Liberty event transporting proceeds from the sale of tickets, t-shirts, stickers and campaign material. Bierfeldt repeatedly asked the agents to explain the scope of their authority to detain and interrogate him and received no explanation. Instead, the agents escalated the threatening tone of their questions and ultimately told Bierfeldt that he was being placed under arrest. Bierfeldt recorded the audio of the entire incident with his iPhone.

“I do not believe I should give up my constitutional rights each time I choose to travel by plane. I was doing nothing illegal or suspicious, yet I was treated like a potential criminal and harassed for no reason,” said Bierfeldt. “Most Americans would be surprised to learn that TSA considers simply carrying cash to be a basis for detention and questioning. I hope the court makes clear that my detention by TSA agents was unconstitutional and stops TSA from engaging in these unlawful searches and arrests. I do not want another innocent American to have to endure what I went through.”

“Mr. Bierfeldt’s experience represents a troubling pattern of TSA attempting to transform its valid but limited search authority into a license to invade people’s privacy in a manner that would never be accepted outside the airport context,” said Larry Schwartztol, a staff attorney with the ACLU National Security Project. “Just as the Constitution prevents the police on the street from conducting freewheeling searches in the hopes of uncovering wrongdoing, it protects travelers from the kind of treatment Mr. Bierfeldt suffered.”

TSA officials have the authority to conduct safety-related searches for weapons and explosives. According to the ACLU’s lawsuit, TSA agents are using heightened security measures after 9/11 as an excuse to exceed their search authority and engage in unlawful searches that violate the privacy rights of passengers. The lawsuit also charges that unconstitutional searches and detention by TSA agents have become the norm.

The ACLU’s lawsuit was filed against Janet Napolitano, Secretary of the Department of Homeland Security, which has authority over TSA. It was filed in federal court in Washington, D.C.

Attorneys on the case are Wizner, Scott Michelman and Allen Hopper of the ACLU, Art Spitzer of the ACLU National Capital Area and cooperating attorney Alan Gura of Gura and Possessky, P.L.L.C.

More information about the case, including the ACLU’s complaint and an audio recording of Bierfeldt’s detention and interrogation, is available online at: www.aclu.org/safefree/general/39922res20090618.html

Gen Y – the Libertarian Generation?

Thursday, June 18th, 2009

Garry Reed – Dallas Libertarian Examiner

A recent Libertarian Party of Texas news release began, “Three highly-regarded national polls have confirmed a growing Libertarian trend in U.S. politics.”

The Pew Research Center annual report on political values and trends concluded, “these independents are more likely to be economically conservative and socially tolerant.”

In simple lay terms, that defines libertarians.

The Washington Post/ABC poll reported, “87% of Americans are concerned by the growing federal deficit, and 53% were not confident in the government’s ability to cut wasteful spending in the President’s economic recovery package.”

Which is another way of saying that a majority of Americans take the libertarian view on these issues.

A Rasmussen Reports poll discovered that “Fifty-nine percent (59%) of politically independent Americans viewed ‘big government’ as the greatest threat” to the country in the future, as opposed to big business or big labor.

Again consistent with libertarian philosophy.

So what does this have to do with Gen Y?

Consider just one source, an opinion piece in the Milwaukee Wisconsin Journal Sentinel by Jim Burkee, The Liberty-loving Gen-Yers will reshape politics.

The demographic that voted for Democrats 2-to-1 were young people between 18 and 29, the leading edge of those born between 1980 and 1995, who are now being tagged as Generation Y.

But Burkee warns the Dems: “While they seem to lean to the left, they’re actually more libertarian than liberal, a fact that will reshape the way we think about liberalism and conservatism in decades to come.”

Burkee’s assessment of the Y’s guys and gals is a daisy-chained litany of libertarian leanings:

“…the most liberty-loving generation since the era of Andrew Jackson…In short, they love their freedom…more likely to see all politicians as corrupt…support liberalization of drug laws…less likely to support restrictions on immigration…they are also free-traders…supportive of globalization…support proposals to privatize Social Security…”

And just for good measure… “It’s the classical liberalism of Milton Friedman, who argued that political and economic freedom are deeply interrelated – that one cannot exist without the other. They’ve grown up with that kind of freedom, and as voting adults, they have come to expect it.”

Sounds pretty exciting for the cause of real freedom in the near future, right?

Unfortunately, Jesse Walker, writing for the libertarian website reasononline, also read the Jim Burkee bit and asks the elder cohort of freedom fomenters, “Sound familiar?”

Walker then cites (1) a 1986 book brought out by the libertarian Cato Institute describing Baby Boomers as “economically conservative but socially liberal” (there’s those libertarianish waffle words again) and (2) a 1995 USA Today print piece claiming that many Gen-Xers reject politics and “lean libertarian.”

So why hasn’t the country become an Anarcho-Capitalist Libertarian utopia already?

While optimism is always preferred, any recipe that calls for baking a future libertarian pie-in-the-sky needs to be taken with that pessimist’s favorite ingredient, a pinch of salt.

Still, the prospect of offering up the just desserts of humble pie to freedom’s enemies would be a dish happily served by libertarians, cold or otherwise.

If the Gen Y-ers really are libertarianesk, let’s whet their appetites for more.

Ron Paul’s Strong Opposition to the War Funding Bill

Wednesday, June 17th, 2009

Ron Paul, before the US House of Representatives, June 15, 2009:

Mr. Speaker, I rise in strong opposition to this conference report on the War Supplemental Appropriations. I wonder what happened to all of my colleagues who said they were opposed to the ongoing wars in Iraq and Afghanistan. I wonder what happened to my colleagues who voted with me as I opposed every war supplemental request under the previous administration. It seems, with very few exceptions, they have changed their position on the war now that the White House has changed hands. I find this troubling. As I have said while opposing previous war funding requests, a vote to fund the war is a vote in favor of the war. Congress exercises its constitutional prerogatives through the power of the purse.

This conference report, being a Washington-style compromise, reflects one thing Congress agrees on: spending money we do not have. So this “compromise” bill spends 15 percent more than the president requested, which is $9 billion more than in the original House bill and $14.6 billion more than the original Senate version. Included in this final version — in addition to the $106 billion to continue the wars in Afghanistan and Iraq — is a $108 billion loan guarantee to the International Monetary Fund, allowing that destructive organization to continue spending taxpayer money to prop up corrupt elites and promote harmful economic policies overseas.

As Americans struggle through the worst economic downturn since the Great Depression, this emergency supplemental appropriations bill sends billions of dollars overseas as foreign aid. Included in this appropriation is $660 million for Gaza, $555 million for Israel, $310 million for Egypt, $300 million for Jordan, and $420 million for Mexico. Some $889 million will be sent to the United Nations for “peacekeeping” missions. Almost one billion dollars will be sent overseas to address the global financial crisis outside our borders and nearly $8 billion will be spent to address a “potential pandemic flu.”

Mr. Speaker, I continue to believe that the best way to support our troops is to bring them home from Iraq and Afghanistan. If one looks at the original authorization for the use of force in Afghanistan, it is clear that the ongoing and expanding nation-building mission there has nothing to do with our goal of capturing and bringing to justice those who attacked the United States on September 11, 2001. Our continued presence in Iraq and Afghanistan does not make us safer at home, but in fact it undermines our national security. I urge my colleagues to defeat this reckless conference report.

Senator Jim DeMint: “It’s time to save freedom.”

Wednesday, June 17th, 2009

Dear Fellow Conservative:

If it concerns you that America is sliding toward socialism, I hope you will join me in supporting a group I am leading to elect true conservatives to the U.S. Senate who will stand up and fight to save freedom.

Saving Freedom Fighting for freedom is the reason I ran for the Senate and it’s also why I wrote a new book called Saving Freedom that I would like to send you.

I’ll tell you more about that in a minute…

But first, I need you to CLICK HERE if you agree that we need to elect more true conservatives to U.S. Senate who will fight for liberty.

As you know, President Obama and congressional Democrats are ramming billions in bailouts, stimulus plans, and pork-barrel projects through Congress as fast as they can.

We desperately need principled leaders in the Senate to stop them, and we need those leaders now.

The tea parties have been great. They are a physical representation of the growing anger Americans have over the direction of our country. But now we need to channel our energy into positive action that makes a real difference.

That is why I formed the Senate Conservatives Fund (SCF). Its mission is to bring bold leadership to Washington by supporting only the most rock-solid, conservative Senate candidates nationwide — candidates who believe in limited government, a strong national defense, and traditional family values.

SCF does this by making financial contributions to candidates, educating voters on key issues, and building a grass roots army of like-minded conservatives across the country who will push our candidates on to victory.

And let me be absolutely clear about something. SCF does not support liberal Republicans and is not affiliated with the Republican Party or any of its campaign committees. SCF only supports conservatives and will support conservative challengers in Republican primaries when it’s necessary.

So if you like wishy-washy Republicans who talk out of both sides of their mouths and try to have it both ways, you won’t like SCF. I will tell you that up front.

But if you love America and you believe it is the world’s greatest bastion of freedom, then you should join our team and help us take back our country.

There are just under 500 days until the 2010 elections, and we have a lot of work to do. SCF has already made three important endorsements for three impressive candidates.

* In Oklahoma, we are supporting the re-election bid of conservative U.S. Senator Tom Coburn. As I’m sure you know, Senator Coburn is a one-man pork-busting machine who has done more to protect American taxpayers from wasteful Washington spending than anyone in Congress.
* In Pennsylvania, we are backing former Congressman Pat Toomey in his race to replace ultra-liberal Senator Arlen Specter, who helped President Obama pass the $1 trillion stimulus bill and recently switched parties to save his political hide.
* In Florida, we have endorsed former Speaker of the House Marco Rubio who is running for the GOP nomination against Governor Charlie Crist. Rubio is a bright, articulate, and principled leader who has what it takes to win this important seat for conservatives.

Right now SCF is working hard to build support across the country for our conservative candidates, but we need your help to succeed.

If you’re ready to take back your country and fight to save freedom, then I hope you will CLICK HERE to make your very best contribution of $25, $50, $100, or even $500 to the Senate Conservatives Fund.

In appreciation of your contribution of $25 or more to SCF, I will send you a copy of the book I mentioned earlier, Saving Freedom.

And for your contribution of $100 or more to SCF, I will send you a personally autographed copy of my book.

I wrote Saving Freedom to help explain the value of freedom in America and describe how it works. I also wanted to give Americans a road map for how we can save it.

I’m making this special offer because I believe we must win a few key Senate races in 2010 or we won’t be able to stop our nation’s slide into socialism.

Many Americans seem to have forgotten how important liberty is, but it’s not too late to save the land of the free.

So please CLICK HERE to help SCF and get your copy of Saving Freedom today.

The benefit from your contribution will go directly and exclusively to SCF so it can help elect true conservatives to the U.S. Senate.

Together, we can strengthening the U.S. Senate and take back our great country.

Your friend,

Jim DeMint

Jim DeMint
United States Senator
Chairman, Senate Conservatives Fund

P.S. When Newt Gingrich read my book, he called it “a new Declaration of Independence.” I hope it is the same for you and your family!

Grand Illusion

Wednesday, June 17th, 2009

In 2003, Barack Obama said he was for single payer.

What would it take to get single payer enacted?

“First, we have to take back the White House, the Senate and the House,” Obama said at the time.

Fast forward six years.

The Democrats have taken the White House.

The Senate and the House.

And now what’s Obama’s position?

In a speech this week in Chicago before the American Medical Association, Obama made clear he was now opposed to single payer.

And his lieutenants suggested that Obama would support legislation to make sure that single payer does not become a reality in America.

There’s only one explanation for Obama’s flip-flop on single payer.

The health insurance and drug corporations have a hammerlock on Washington.

And Obama is going along to get along.

What’s the net result?

Sixty Americans are dying every day due to lack of health insurance. (Institute of Medicine report.)

Instead of getting behind single payer, Obama and the Democrats are engaged in the what Dr. Marcia Angell, former editor-in-chief at the highly regarded New England Journal of Medicine calls “the futility of piecemeal tinkering.”

Earlier this week, the Congressional Budget Office (CBO) estimated that the most liberal of the Democrats’ tinkering plans would cost $1 trillion over ten years and still leave 37 million Americans uninsured.

Single payer on the other hand would cost less than we are overpaying now — and cover everyone.

Zero uninsured.

As Dr. Angell puts it — single payer is not only the best option.

It’s the only option that will both control costs and cover everyone.

Replace 1,300 insurance industry payers with one payer.

Save $400 billion a year in bloated corporate administrative and executive compensation costs.

Free choice of doctor and hospital.

Use that money to insure everyone.

No bills, no co-pays, no deductibles.

No exclusions for pre-existing conditions — because under single payer, you are insured from the day you are born.

No bankruptcies due to medical bills.

No deaths due to lack of health insurance.

Cheaper. Simpler. More affordable.

Everybody in. Nobody out.

According to recent polls, the majority of Americans, the majority of doctors, the majority of nurses, even the majority of health economists want single payer.

That’s why almost every health care town hall event I hear about is dominated by citizens speaking out for single payer.

Last month, we asked that you help fund a new non-profit organization – Single Payer Action – to focus this citizen energy, break through the corporate logjam in Washington and make single payer a reality.

You came through with flying colors — and blew past our initial fundraising goal.

The foundation was set for action.

Out of the blocks, Single Payer Action led a stand up protest before Senator Max Baucus’ Senate Finance Committee.

Thirteen doctors, nurses, lawyers and other single payer advocates were summarily arrested and charged with “disruption of Congress.”

(Baucus later told single payer advocates that he regretted not inviting them to testify before his committee.)

The arrests of the Baucus 13, their upcoming trial, and other similar single payer actions around the country have galvanized a nationwide movement.

Single Payer Action now wants to supercharge the grassroots movement for single payer.

Confront members of Congress back home all around the country.

And lay the groundwork for a national citizen’s organization that will refuse to compromise with corporate power — inside the beltway and out.

Many progressives are now confused.

They took Obama at his word.

They thought once Obama was elected President, he would do the right thing.

My colleague, Theresa Amato, is not confused.

Grand IllusionShe saw clearly through the Democratic Party’s duplicity and shenanigans — and has written a new book, titled Grand Illusion: The Myth of Voter Choice in a Two Party Tyranny (New Press, June 2009)

The book documents how the corporate two-party system thwarts citizen activism and blocks challenging candidates in the electoral system and beyond.

Phil Donahue said this about Grand Illusion: “Theresa Amato takes the biggest swing — not a jab, but a roundhouse punch — at America’s corrupt electoral system.”

Single Payer Action needs to raise $50,000 over the next month to fund its actions around the country this summer.

So, please, donate now — $10, $25, $50, $100, $500 — or whatever you can afford.

If you donate $100 or more now, Single Payer Action will send you a copy, hot off the press, of Amato’s hard cover, 379-page masterpiece — Grand Illusion.

(Okay, since it also includes chapters about my campaign against the corporate Republicans and Democrats — and since I wrote the foreword — I’ll autograph it.)

So, don’t delay.

Donate now.

Let’s break through the corporate barriers and make single payer a reality.

Together, we can make the difference.

Onward to a life-saving, cost-saving single payer.

Expert urges U.S. gov’t to change policies of taxing, spending

Sunday, June 14th, 2009

www.chinaview.cn 2009-06-15
By Jing Zhao Cesarone

CHICAGO, June 14 (Xinhua) — Taking issue with the Obama Administration’s contention that the economy is showing signs of recovery, Peter Schiff, a well-known American economic commentator, firmly believes that this economy will never recover unless the government changes its policies of taxing, spending and expanding the government.

Schiff, currently serving as president and chief global strategist of the brokerage firm Euro Pacific Capital Inc, told Xinhua during an exclusive interview on Saturday that “the things the government is doing with the economy only put us into deeper debt and deeper trouble. All they will probably do is buy us time, interfere with the current situation and postpone the unpleasant consequences in exchange for more damage in the future.”

Regarding recent numbers showing slight growth in retail sales and a dip in first-time jobless claims, Schiff said, “they’re depending on that to reign in the massive deficits they’re creating. But they aren’t doing anything that will lead to recovery; they’re doing the opposite!”

As an expert on money, economic theory, and international investing, Schiff is best known for his prescient predictions of the economic crisis of 2008. He is one of the few investment advisors to have correctly called the current bear market before it began.

He said, “the Obama Administration will be like Jimmy Carter’s. They’re going to tell everyone to ‘sacrifice’ to support a government that is just too large and too powerful. Regarding interest rates, Schiff noted, “We may have reduced interest rates now, but with higher inflation, we will have to raise them in the future. Then, we will have recession, rising prices, and no available credit. This will smother any potential for recovery.”

Turning to the unemployment rate, Schiff pointed out, “the current headline unemployment rate of 9.5 percent does not truly capture the situation on the ground because it ignores those who are ‘marginally attached’ to the workforce; 16 percent is more realistic representation of the situation, and I estimate about a 20 percent unemployment rate by the end of this year.”

Commenting on the government’s stimulus plan and its effect on job creation, Schiff said: “The kind of jobs created by the government stimulus are not productive and viable for the economy, but the private sector is forced to subsidize them. Not only are they a drain on the real economy via taxation, they also divert human capital from private businesses.”

Then what should the government do to bring the economy back on track? Schiff advised: “If the government changes its policies, the economy will start to recover immediately. But the symptoms will get worse before they get better. It’s like ripping off a band-aid — they’re so worried about the pain that they’re pulling it off slowly. If they just ripped it off, it might hurt a lot for a second, but then it would be over and we could move on.”

Schiff criticized the Federal Reserve as the ultimate culprit in this crisis. He said, “in response to the dot-com bust, Alan Greenspan kept interest rates artificially low to stimulate the economy. The only thing he stimulated was an artificial boom in real estate and stocks. Now, we’re paying for that with a recession.”

“Instead of allowing this restructuring to happen, Ben Bernanke has dropped interest rates to near-zero and started intervening directly in the market. He’s ‘monetizing’ Treasury debt to make up for a drop in foreign demand. These policies will lead to a collapse in the dollar, which will be much worse than the current crisis,” he added.

Schiff is a supporter of the Austrian School of Economics and the Ludwig von Mises Institute, and was an economic adviser for Ron Paul’s campaign in the 2008 Republican Party primaries, through which Schiff also expressed support for sound money, limited government, and free market capitalism.

Young American’s For Liberty

Saturday, June 13th, 2009

Dear Friend of Liberty,

Today, I’m thrilled to inform you of two major announcements from Young Americans for Liberty.

On the heels of a semester of overwhelming success, my staff and I have not wasted a moment to prepare for the battles that lie ahead.  In fact, we are working overtime this summer to develop our plan of action for the coming school year.

And let’s not forget, campaign season is right around the corner.

That’s why Young Americans for Liberty is taking full advantage of this summer.

As we kick into high-gear, I’m proud to announce that YAL is launching a groundbreaking new website!

Phase 1 of the website will launch July 1, just in time for Independence Day.  This will be the first step in developing an extensive grassroots-based online platform that gives our chapters and youth activists the tools to advance liberty on their campuses.

You can receive up-to-the-minute alerts on our website launch by signing up for Young Americans for Liberty email reports.

Please keep up with YAL by signing up for these alerts at www.yaliberty.org.

To excite you with our early progress, I’d like to give you a sneak peek of the homepage of our new website.  We’re still working out the kinks, but I think you will be very impressed with the design.  Click here to check it out.

Aside from our impressive new website, I’m especially pleased to announce the 2009 YAL National Convention in Arlington, VA, July 30 – August 2.

The first-ever YAL National Convention is a very intimate, three-day event bringing together the top youth activists from across the country to receive the best political training available.

Now is the time to prepare for the 2010 election cycle, and YAL’s expert teachers will equip you with the skills to win elections for liberty candidates.

If you are a member of YAL, you are invited to apply for an exclusive seat at the convention.  Only 50 of the top youth activists in the country will be accepted to attend.

To apply, please fill out the application here.

A full schedule of the YAL National Convention will be released shortly, and it will include a very special keynote speaker.  It’s an event you won’t want to miss!

Thanks to our generous donors, ticket prices are only $30, and attendees will receive free lodging, meals, training, and supplies at the convention.  All you have to do is get there.

Needless to say, we are building quickly on last semester’s success.  Your support of Young Americans for Liberty makes these efforts possible, and for that I am forever grateful.

My staff and I will continue working long hours this summer to prepare for the upcoming school year and the 2010 election season.

Please be sure to visit our new website when it launches July 1st and apply for the 2009 YAL National Convention to receive the best political training around.

Call the Capitol Now, No More Money For Wars

Friday, June 12th, 2009

Voting on the supplemental is imminent, and the outcome is
NOT a foregone conclusion.

That’s why we’re asking you once again to call your Congressional
representatives and tell them to vote ‘NO’ on the bill, H.R. 2346.

This time, though, we don’t want you just to call your own Congressional
representatives. We also need you to reach out to representatives who
remain undecided or are tentatively leaning ‘YES’ or ‘NO’.

This can be done with Firedoglake’s Citizen Whip Tool
, which
helps you find out where Democratic representatives are leaning on the
Supplemental. The goal is to target those Democrats who are either ‘Leaning
NO’, ‘Undecided’, or ‘Leaning YES’. The major national peace and justice
groups, with which UFPJ works, culled together this targeted list with your
report-backs.

To reach the Capitol Switchboard, call this number: 202-224-3121.

Your phone calls made a big difference in the first round of votes, as 51
antiwar House Representatives voted against the Supplemental. And now, due
partly to our pressure earlier this week, the Graham-Lieberman torture
amendment will be taken out of the reconciliation bill. However, the IMF
funding remains — and most importantly, so does the funding for the wars
and occupations of Iraq and Afghanistan.

That’s why we need to make these calls, express our opposition to more war
spending, and force our Congressional representatives to take a stand!
Let’s send a strong message to Washington: end these wars!

Thanks,

United For Peace and Justice
