Dear Friends,

In just another day, we will all observe Independence Day. Yet, like you, we all realize that our freedoms have never been so threatened both from within and without. We wonder what actions we should take. We wonder what happens if we wait too long? I know we all wish for some clarion call from some leader with a response commensurate to the challenges we are seeing. A recent news analysis from Rachel Maddow (MSNBC News) of a major policy speech made by our President in May prompted me to write this open letter to the President as my next step. As you watch this news clip, you will likely find that the President’s attitude toward the Rule of Law and the Constitution is even more alarming than what he is proposing. I hope that this video and my letter will further develop your thinking as we celebrate Independence Day. While I stop short of suggesting a specific collective action that American citizens can take, I believe that history lays out the pattern.

Dear Mr. President,

I write to you as one elected official to another on behalf of average American citizens. We listen to your words and measure them carefully. With hope, we watch your actions. We then look to history and compare the events of our day with the events of yesterday. We look to our Founders and read carefully their intellectual discourses and their moral debate. They ultimately concluded that the actions of the king were best described as tyranny, because they could not be honestly described any other way. Having come to such a serious and reasoned conclusion, their path was charted-unknown as to its outcome-but certain as to its demand upon them. Mr. President, we are doing what Americans have done before.

Many of your words, at face value, inspire and offer some level of hope. This is why many Americans cast their vote for you. Yet, now that you are in office, your actions are inspiring fear and distrust. At nearly every level, Americans, regardless of political party, are being forced to walk down the same road our Founders were forced to walk – questioning, analyzing, and looking deep within their souls. The similarities between the past and the present are amazing. If you desire to test the American people’s resolve and challenge their patience, you are accomplishing your goal. You know what is happening within the hearts and minds of the average American. That is why state legislatures are offering and passing resolutions, re-affirming the 10th Amendment and state sovereignty issue. That is why the Tea Party movement is growing by the day and is attended by rich and poor alike. That is why you and Congress are hearing from the American public in record numbers on an increasing range of major issues including the bail-out, the stimulus plan, “cap and tax”, and government intrusion into health care.

Your speech sounds sensitive to the economic and emotional needs so heavy on our people. Yet, your continued references to being guided by the “Rule of Law” (our Founders knew this meant God’s Higher Law and the Highest Law of the Land – the Constitution) are hollow and disingenuous. Your recent speech in front of the original Constitution of the United States of America in the National Archives makes it all so clear that your words mean nothing. Your agenda and you yourself appear to be that “rule of law” – effectively setting aside all Constitutional constraints. It’s unfortunate that I must be so direct, but you are leaving the American people with very few options.

Mr. President, it is clear by your speech and actions that your oath to the Constitution is not binding to you and, therefore, is a broken oath. On many fronts, so much of significance has happened in such a short time. You (and the Congress) are overriding state sovereignty and encouraging the states into unsustainable programs through Stimulus Funds: this will force them to beg you and the elite in Washington for help when the funding runs out. Your policies are destroying the wealth of hard-working Americans by plunging this nation into inescapable debt to our enemies and by justifying the disastrous printing of trillions in fiat money. What you and the Federal Reserve do not destroy immediately by exploding our debt, will be completely devoured by the ensuing hyper-inflation. What an insidious way for you and Congress to spend what you do not have by robbing it from every hard-working American who has responsibly worked and saved!

You have violated historic contract law by choosing who wins and who loses, while Chrysler and General Motors is eviscerated and turned into ‘Government Motors’. You have thumbed your nose at the ‘Balance of Power’, so carefully conceived and implemented by our Founders, by appointing unaccountable “Czars” to function as your direct emissaries over fundamental areas of public policy, thereby blatantly by-passing the checks and balances of Congressional oversight. You pursue special interest agendas motivated by the faddish science of “Global Warming” or “Climate Change”, or whatever it will be called next. In the ‘cap and tax’ plan, you justify the biggest tax assault on the American people ever conceived. Yet, you boldly assure the American people that it will cost them nothing, since only the “polluters” will pay. But, in the process you will destroy thousands of truly sustainable jobs (in exchange for temporary “green” jobs – like insulating buildings and re-caulking windows). Bringing America to its knees in financial dependence, in energy dependence, and a gutted manufacturing sector is sadly what’s happening. It appears that in reality, the “Change” you promised is just your personal change-clearly not what the American people so desperately hoped for.

So Mr. President, these things that I and the American people have come to observe and conclude are bringing this nation to a point closer each day that resembles the circumstances that forced the hearts, the minds and then the hands of our Founders. As we quickly approach the remembering of Independence Day – July 4, 2009, please remember that as you make your choices, so must we. May you and all the American people reread the Declaration of Independence – very carefully. Identify the principles they clearly stated and then apply them to today. Feel the intensity of the letter sent to the King. Understand the careful steps they undertook to make the moral case for freedom and independence in the context of the history of mankind. Note in particular the foundational precepts woven into paragraph two, written as much for the benefit of Americans yet unknown and unborn as it was a message to King George. As the President who holds the highest elected position in both honor and responsibility in this Republic, place yourself in the position of the King, look in the mirror, and then look across this great land at the faces of our great people and listen to their pleas. The King didn’t know for sure all that Declaration Letter would mean for him, but I am certain that he knew he had ignited the will and passion of a freedom-loving people for which only time would prove the outcome.

So it is today. Now, we have the Constitution against which to compare the words and actions of those in public office. The people, Mr. President, are awaking. They are realigning their priorities, purifying their motivations, and galvanizing their wills. Their freedom and their families are what they love and, thankfully, what they will defend. As to what comes next, I cannot say. I do know that another Declaration Letter is not necessary since this country already belongs to us. Our freedom and this republic are already ours. It is the return of freedom they demand. It is nothing less than the adherence to the Constitution and to the oath we have both taken that they demand. We, continuing to carefully note and compare as our Founders did, are also coming to serious and reasoned conclusions. Our path is charted – unknown perhaps as to its ultimate outcome – but certain as to its demand upon us.

Representative Ron Paul continues to receive cosponsors on his Audit the Fed bill (H.R. 1207). With 245 cosponsors in total, one has to wonder why this bill has been unable to move ahead in the House for floor debate and an eventual floor vote.

The Senate companion bill (S. 604) offered by Senator Bernard Sanders (R-VT) carries only 3 cosponsors (Senators Mike Crapo, R-ID; Jim DeMint, R-SC; and David Vitter, R-LA). However, the Senate version of the bill had a chance for passage when Senator Jim DeMint (R-SC) opted to attach S. 604 to the Legislative Branch Appropriations Act (H.R. 2918) as an amendment. DeMint’s attempt to force the Senate to consider the bill through the amendment process failed when Senate leaders rejected having a vote on the amendment claiming it violated Senate rules. The appropriations bill passed without a vote on the DeMint amendment, even though the bill had several other provisions for the Government Accountability Office (GAO) to audit various other agencies. This issue cannot be ignored forever. With more and more support to audit the Federal Reserve, congressional leaders will soon have to deal with this issue in one way or another.

Continue to contact Congress and urge them to support H.R. 1207 and S. 604. If your representative and senators are co-sponsors already – GREAT! If not, you should continue to call, e-mail, or visit their office. Let them know that you support a complete audit of the Federal Reserve and that you wish for them to become a sponsor of either H.R. 1207 or S. 604.

Dear Friend of Liberty,

Earlier today, the first shot in our battle to pass Audit the Fed through the U.S. Senate was fired on the Senate floor by Senator Jim DeMint of South Carolina.

Senator DeMint, who has a well-deserved reputation for taking the battle to the other side in the Senate, once again proved why he is such a valuable ally in our fight to bring transparency and accountability to the Federal Reserve.

A little while ago, the Senate voted to pass HR 2918, the Legislative Branch Appropriations Act. This $3 billion bill contains, among many other things, provisions for GAO audits on certain agencies.

Seizing on a chance to take quick action to bring Audit the Fed up for a vote, and with the GAO provisions in mind, Senator DeMint attached the full text of S 604, the Senate version of Ron Paul’s Audit the Fed bill, to HR 2918 as Senate Amendment 1367 before it was considered for final passage.

However, Senate Democrats refused to even allow a vote on the amendment! That’s right. The internationalist, Fed-loving elite in the Senate used a parliamentary tactic to shut down DeMint’s amendment.

After Senator DeMint brought Audit the Fed to the floor, Senator Ben Nelson of Nebraska raised a “point of order” to prevent a vote, claiming that the amendment violated Senate Rule 16 by “legislating” on an appropriations bill. The Senate president agreed, and the amendment was shot down.

Senator DeMint did not back down, though, and directly challenged Senate leadership by pointing out the other GAO audits contained in the bill. As Senator DeMint listed them off, the Senate president was forced to agree with Senator DeMint that each one he described, all of which would be left in for final passage, also violated Senate Rule 16.

Which tells us at least one thing: the problem wasn’t with “legislating” on the bill or violating Senate Rules (which is commonly done). Shooting down the amendment was about preventing a thorough audit of the Federal Reserve for the first time in its history!

Senate leadership is hoping this issue will just fade away so they can get on to what they deem to be more “important” business, like dictating what kind of healthcare plan you and I can carry or passing destructive Cap-and-Tax legislation.

But the American people deserve answers on what the Fed has done with trillions of our tax dollars and what they are committing us and future generations to as part of their secret deals with foreign central banks and governments.

The leadership decided today to turn their backs on transparency, but our fight is just beginning.

As Senator DeMint made clear on the floor, the Audit the Fed bill has wide bipartisan support. He rightly warned the Senate that even if they delay today, they WILL have to deal with the issue on the floor.

It is up to you and me to back up Senator DeMint’s words by making sure the momentum continues to build and the bill comes up for a final vote.

The rejection of the Audit amendment is just the first battle in our war. Now is the time to really put the pressure on the U.S. Senate to Audit the Fed!

Senator DeMint fired the opening salvo and showcased the hypocrisy of the Senate for allowing other GAO audits to be included in the bill while refusing to even allow a vote on Fed transparency.

Again, we’re just getting started. Senator DeMint will keep fighting to pass Audit the Fed on its own or as an amendment, and we need to continue putting pressure on our senators to do everything in their power to achieve a floor vote!

Every year on the Fourth of July we remember our founding fathers and the precious inheritance of freedom that they secured for us. Every year it seems we get further and further away from that birthright, but we still have much to celebrate.

This country was founded on principles of freedom from overbearing rulers, onerous taxation, and the right to live our lives as we see fit. Our independence was won after decades, and even centuries of abuses that unscrupulous, corrupted leaders and big governments visited upon their subjects. The Founders knew there was a better way, and they forged it here on this soil.

In the new United States of America, the rights of the individual were enshrined in the Bill of Rights. Today, government encroaches on those rights through countless provisions in numerous laws. However, how much worse off might we be had the Founders not enumerated these rights in the highest law of the land? While it is true that many aspects of those rights have been redefined and watered down, and will likely continue to be eroded, we can celebrate the wisdom of the Founders and that at our very core we, as Americans, still hold these rights dear.

The American tradition of individual liberty and self-reliance still runs deep, in spite of the increasing nanny state tendencies that government has been gradually shoving down our throats. It is sad to see government seeking to completely replace the voluntary protections through families and charities that we have relied on throughout our history. Especially disturbing is the rhetoric of community and interdependence being employed by the administration to institute government as the great middle man for all healthcare and charity for which all citizens must dutifully sacrifice. This trend is not improving quality of life for Americans, but instead is greatly enriching the government bureaucracies that take a generous cut of all transactions in the welfare state. There still remains much resistance to cradle to grave government dependence and control. This spirit of fierce independence is a tribute to our founders and is cause to celebrate.

The majority of our Founders believed in sound money, in part because they knew it kept government in check. Governments that are unable to expand the money supply and manipulate credit at will are unable to fund frivolous wars of conquest. Instead of adventurism abroad, seeking monsters to destroy, governments restrained by sound money are restricted to truly defensive wars that the people are willing to fight and to fund. Today, in spite of all the economic turmoil that fiat currency and military interventionism has caused, there is cause to celebrate. The demand to audit the Federal Reserve is quite encouraging. The truth about the fed will put us one step closer to sound money, and peace.

Public outcry against the bank bailouts and the government power grab known as cap-and-trade proves that the spirit of liberty still lives. Part of our celebration of Independence Day should include a renewed determination to keep fighting the good fight for freedom. As long as government continually seeks to take liberties away, patriots need to keep fighting this ongoing war for sustained independence.

Dear Ms. Serdula:

Thank you for contacting me in regards to H.R. 1207, the Federal Reserve Transparency Act of 2009. As I work to meet the needs of our community and our nation, please know how much I value having the benefit of your views.

During this current recession it is crucial that we take action to
jumpstart the economy and put Americans back to work, while always being mindful of the bottom line. Reckless spending without oversight is not the answer. As your Congressman, I have strongly advocated the need to monitor our spending and ensure transparency in all government agencies and programs.

For these reasons, I am pleased to report to you that I am a proud
cosponsor of H.R. 1207. As you know, H.R. 1207 requires the Comptroller General of the Government Accountability Office (GAO) to audit the Federal Reserve banks and the Board of Governors of the Federal Reserve System by the end of 2010, and to submit a report of their findings to Congress. The bill also lifts certain previous restrictions that limited the GAO’s ability to perform audits on federal agencies. The Federal Reserve plays an important role by serving as a backbone for the banking system, but it has too often conducted its operations in an unclear manner and with minimal oversight. In light of its responsibilities, it is imperative that the Federal Reserve’s operations are fully transparent, and I believe H.R. 1207 contains the measures necessary to ensure that this is the case. By eliminating restrictions on GAO audits, the bill will open up the Fed’s funding facilities – such as the Primary Dealer Credit Facility, Term Securities Lending Facility, and Term Asset-Backed Securities Lending Facility – to Congressional oversight. Congress and the American people will be able to monitor how and to whom the Federal Reserve is lending taxpayer dollars.

Our recent economic difficulties further underscore the need for
openness and accountability in this area. You may also be interested to know that I voted for H.R. 384, the Troubled Assets Relief Program
(TARP) Reform and Accountability Act of 2009. This important bill would bring much needed accountability and transparency to the way in which TARP money has been distributed to banks and financial institutions. I’ve been very upset to hear the reports of how this money has been distributed, and even angrier to hear that it required the threat of a subpoena to force financial institutions to release details about their involvement with this program. In particular, I felt it was necessary to shed light on the half a trillion dollar deal, made last November, in which the Federal Reserve purchased mortgage-backed securities (MBS) and then contracted out the management of these securities to four private investment firms. The American people have a right to know how this arrangement was conducted, which is why I introduced an amendment to H.R. 384 that requires the Federal Reserve to disclose how the investment managers for the MBS Purchase Program were selected. In addition, the amendment necessitates that the government provide details of both the manager contracts and the steps taken to ensure that the program remains free from conflicts of interest. This amendment unanimously passed the House on January 15, 2009, and H.R. 384 is currently awaiting consideration by the Senate.

Guaranteeing oversight and financial responsibility has always been one
of my foremost priorities. In the last session of Congress, I introduced H.R. 5467, the Improper Payments Elimination and Recovery Act
of 2008. This legislation, which was cosponsored by Congressman Ron
Paul, requires the head of each federal agency to annually review all
agency programs and identity those programs and activities that made
payments that should never have been paid – either through error or
ineligibility. This bill is a necessary step in the process of getting
our fiscal house in order, and I look forward to reintroducing it to the
111th Congress and working towards its passage.

Hearing from the families I serve is vital to doing my job right.

Last week The John Birch Society updated our subscribers on the Clean Water Restoration Act (S. 787) which would place virtually all waters of the United States under the control of the federal government.

As if that is not enough, there is another bill in the House that would place federal control on much of the food industry.

Representative Rosa DeLauro (D-CT) introduced the Food Safety Modernization Act of 2009 (H.R. 875) on February 4, 2009. The bill, which currently carries 40 cosponsors, would effectively transfer all state control over food regulation to the Food Safety Administration (FSA), a newly established federal bureaucracy to be created within the Department of Health and Human Services (DHHS). It would very likely contribute to the eventual abandonment of all independent, family farms as well as all organic farming operations due to the high probability of overbearing federal regulations arbitrarily determined by FSA in favor of corporate factory farms.

H.R. 875 would violate the Tenth Amendment of the U.S. Constitution by delegating what should be state-level authority to the federal government. The burdensome record keeping that would be required by the FSA would threaten the success of small agricultural businesses and family-owned farms who may not be able to comply with new federal restrictions.

While all Americans should be concerned about yet another power grab at the hands of the federal government, family farm and other small agricultural businesses should be especially cautious of H.R. 875 as it threatens their own businesses and way of living.

Please take a few moments of your time and urge your representative to oppose the passage of H.R. 875 and support the future success of family farms and small agricultural businesses.
